1. Appointment

The proposed appointment, date and duration of the mediation, and applicable fees will be agreed in advance and recorded in writing.

The Mediator acts independently and impartially.

The conduct of the mediation will be governed by a separate Agreement to Mediate.

2. Fees and Expenses

2.1 The mediation fee will ordinarily be shared equally between the parties, unless otherwise agreed.

2.2 The agreed fee covers preparation, preliminary communications, reserved professional time and attendance at the mediation. It is not contingent upon settlement or any particular outcome.

2.3 Additional preparation, an extension of the mediation or subsequent work will be charged at rates agreed in advance.

2.4 The parties are responsible for arranging and meeting the cost of the mediation venue. Any travel or other expenses incurred by the Mediator will be agreed separately.

3. Payment

3.1 Fees and agreed expenses are payable no later than ten working days before the mediation, unless otherwise agreed in writing. An appointment is confirmed upon receipt of payment.

3.2 Payment must be received before preparatory work commences.

3.3 The Mediator reserves the right to postpone or decline to proceed with an appointment where payment has not been received in accordance with these terms.

3.4 Additional fees and expenses incurred in accordance with these terms will be invoiced following the mediation and are payable on receipt.

4. Cancellation and Postponement

4.1 Any cancellation or request for postponement must be communicated promptly and in writing.

4.2 Where cancellation or postponement occurs more than ten working days before the mediation, an administration charge of £250 per appointment will apply.

4.3 Where cancellation or postponement occurs within ten working days, but more than 48 hours before the mediation, 50% of the agreed fee will be payable.

4.4 Where cancellation or postponement occurs within 48 hours of the mediation, the full agreed fee will be payable.

4.5 For the purposes of these provisions, cancellation includes failure to attend an agreed mediation appointment where no clear written notice of cancellation has been given.

4.6 Agreed expenses already incurred and any additional preparation charges properly payable will remain due.

4.7 Working days exclude weekends and public holidays in England and Wales.

4.8 Cancellation and postponement charges will be shared between the parties in the same proportions as the agreed mediation fee, unless otherwise agreed between them.

5. The Mediation Process

The mediation will be conducted in accordance with the Agreement to Mediate, a sample of which will be provided to the parties for review in advance of the mediation.

6. Personal Information

Personal information will be processed for the purposes of administering and conducting the mediation, in accordance with the Mediator's Privacy Policy.

7. Governing Law

These Terms of Appointment are governed by the law of England and Wales.

These Terms of Appointment apply to direct appointments. Where an appointment is made through mediation chambers, the chambers' own terms may apply.

1. About This Policy

I respect the privacy of those who contact me, use my website or participate in my professional services. This policy explains how I collect, use, retain and protect personal information in connection with my mediation and coaching practice and my Insights newsletter.

I am responsible for the personal information processed in my professional practice. You can contact me about this policy at privacy@amandabucklow.co.uk.

2. Information I Collect

I collect personal information when you contact me, enquire about mediation or coaching, make an appointment or subscribe to my Insights newsletter.

Depending on the nature of our contact, this may include your name, contact details, professional information and correspondence relating to an enquiry or appointment.

Where I am appointed as mediator, I may also receive documents and other information relating to the dispute, including personal information about individuals who are not parties to the mediation.

Newsletter subscriptions are managed through Buttondown, which collects the email address you provide when subscribing.

3. How I Use Your Information

I use personal information to respond to enquiries, provide mediation and coaching services, arrange and conduct mediations, administer appointments and fees, maintain appropriate professional and financial records, and meet my legal obligations.

Depending on the circumstances, the lawful basis for processing is taking steps towards or performing a contract, complying with a legal obligation, pursuing legitimate interests in administering my professional practice, or your consent where required.

Information received in connection with a mediation may include sensitive personal information, including special category data. Where this occurs, I process it only where there is an applicable lawful basis and an additional condition under data protection law, having regard to the nature of the dispute and the information necessary for the mediation.

4. Confidentiality

I treat information received in connection with a mediation as confidential, subject to the Agreement to Mediate and any applicable legal obligations or exceptions.

I do not sell personal information or share it with third parties for their marketing purposes.

Where I am invited to provide contact details to an independent professional research directory, I first contact the individual concerned and seek their express permission to share those details and confirm their willingness to provide a reference. Participation is entirely voluntary.

5. Data Security and Service Providers

I take steps to protect personal information against unauthorised access, loss or disclosure.

I use external service providers for website hosting, email communications, electronic document storage, newsletter subscriptions and business administration. These include Krystal for website hosting, IONOS for email, Dropbox for document storage and Buttondown for my Insights newsletter.

Where a service involves processing personal information outside the United Kingdom, I take steps to establish that an appropriate legal basis or safeguard for the transfer applies.

6. Retention and Disposal

Mediation bundles, position statements and other substantive case documents are normally retained for twelve months following the conclusion of the mediation, after which they are securely deleted or destroyed, unless there is a legitimate reason for longer retention.

Administrative correspondence, appointment records, participant contact details and financial records may be retained for longer where reasonably necessary for legitimate professional, legal or accounting purposes. They are not retained for unsolicited marketing.

Paper documents requiring confidential disposal are destroyed through a professional shredding service. Electronic records are deleted using the facilities provided by the relevant storage systems.

7. Insights Newsletter

You may subscribe to receive my Insights by email. Subscriptions are managed through Buttondown, which processes your email address to deliver the newsletter and administer your subscription.

You may unsubscribe at any time using the link provided in each email.

8. Website Cookies

My website has been checked for cookies and browser storage associated with its current public-facing pages and newsletter subscription process. Those checks did not identify cookies or stored data being set by the features tested.

I will review this position if the website's functionality or services change.

9. Your Rights

Under UK data protection law, you may have rights to access your personal information, request correction or erasure, restrict or object to certain processing, and request data portability where applicable. Where processing relies on consent, you may withdraw that consent at any time.

These rights are subject to legal conditions and exceptions, including obligations relating to confidentiality and the rights of others.

To exercise your rights, please contact privacy@amandabucklow.co.uk. I will respond in accordance with the applicable legal time limits. Requests are normally handled without charge.

You may also raise a concern with the Information Commissioner's Office at ico.org.uk.

10. Changes to This Policy

I may update this policy to reflect changes in my professional practice, website services or legal requirements. The current version will be available on this website.
