TERMS OF SERVICE

This website (“Site”) is owned and operated by Amanda Bucklow (“Amanda Bucklow,” “Company,” “we, or “us”). By using this Site you agree to be bound by these Terms of Service (“TOS”), the Privacy Policy, and any additional policies applicable to specific areas of the Site or Product. These TOS apply to free services delivered through the Site, and not to paid services, including mediation, coaching, in-person training, consultation, or other services whether delivered through the Site or another manner. Paid services delivered through the Site have their own Terms of Service.

Accessing the Site, in any manner, whether automated or otherwise, constitutes use of the Site and your agreement to be bound by these TOS and your compliance with any applicable local laws. If you do not agree to these TOS, do not use the Site.

Disclaimer

Amanda Bucklow (“Amanda”) has a background in and knowledge related to conflict, conflict resolution, negotiation, and running a conflict resolution private practice. Amanda is not a psychotherapist, counsellor, human resources manager, employment specialist, financial advisor, accountant, lawyer, medical doctor, business manager, or manager and neither this Site nor any information provided on the Site by us or others replaces advice or counsel from any such professionals. You understand that Amanda Bucklow has not promised, will not, nor shall be obliged to procure or attempt to procure business or sales for you or perform any business management or human resources functions for you.

You expressly understand and agree that your use of the Site is at your sole risk. The Site is provided on an “as is” and “as available” basis. Amanda Bucklow and and her affiliates, officers, employees, agents, partners and licensors expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. Information provided to establish a User Account on the Site is not considered privileged, and no privileged relationship is created by establishing a User Account. Certain services provided through the Site may create a privileged relationship, but those will be specifically identified when those services are obtained.

Amanda Bucklow, her affiliates, employees, agents, partners and licensors make no warranty that (1) the Site or any other services provided by Amanda Bucklow will meet your requirements; (2) the Site will be uninterrupted, timely, secure or error-free; (3) the results that may be obtained from the use of the Site will be accurate or reliable; (4) the quality of any products, services, information or other material obtained by you through the Site will meet your expectations; (5) new materials will be available at all or on any particular timeline; and (6) any errors in the software will be corrected. Any material downloaded or otherwise obtained through the use of the blog is accessed at your own discretion and risk, and you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.

No advice or information, whether oral or written, obtained by you from Amanda Bucklow or through or from the Site shall create any warranty not expressly stated in the TOS.

Amanda Bucklow assumes no responsibility for the timeliness, deletion, mis-delivery, or failure to store any User communications or personalisation settings. You are responsible for obtaining access to the Site, and are solely responsible for any third-party fees, such as Internet service provider or airtime charges, associated with that access. You must also provide and are responsible for all equipment necessary to access the Site.

Your obligations

In consideration of your use of the Site, you represent that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of England and Wales or other applicable jurisdiction. You also agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the Site’s registration form (the “Registration Data”) and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or Amanda Bucklow has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Amanda Bucklow has the right to suspend or terminate your account and refuse any and all current or future use of the Site (or any portion thereof).

Registration Data and certain other information about you is subject to our Privacy Policy and through your use of the Site you consent to the collection and use of the information set forth therein.

You are responsible for maintaining the confidentiality of any password and account information associated with using the Site and are fully responsible for any and all activities that occur under your password or account. You agree to notify Amanda Bucklow immediately of any unauthorised use of your password or account or any other breach of security.

Users under 18 years of age

Our Site is not directed to and we do not knowingly collect personal data from children under the age of 18. If we become aware that a child under the age of 18 has provided us with personal data, we will take steps to remove such data. If you become aware that your child has provided us with personal data without your consent, please contact us. By using the Site, you are representing to us that you are not under the age of 18.

User conduct

The Site is intended to be a resource and gathering place for sharing ideas related to effective conflict resolution. Amanda Bucklow does not take responsibility for comments by visitors and members (“Users”), nor do we endorse the ideas, suggestions, opinions, comments and observations, any text, data, photographs, video, music, sound, chat, messages, files or other material provided by Users.

You understand that by using the Site, you may be exposed to content that is offensive, indecent, or objectionable. Under no circumstances will Amanda Bucklow be liable in any way for any content, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted or otherwise made available through the Site. Amanda Bucklow makes no guarantee regarding the reliability, accuracy or quality of any content. You acknowledge that you will evaluate and bear any risks related to your use.

Amanda Bucklow does not claim any ownership rights in content posted by Users. By submitting comment, discussion forum or other posted content, you are representing that you are the creator of the material you submit or have full authorisation to distribute it. After posting content, you continue to retain any ownership rights in such content, and you continue to have the right to use your content in any way you choose.

You may not use the Site to advertise, market or explicitly promote your own services to other users of the Site and understand that doing so may result in the revocation of your privilege to use the Site.

If you choose to post content on the Site, we require that you adhere to generally accepted rules of etiquette and standards of behaviour and that your use of the Site reflects your respect for the legal rights of readers connected with the Site. Comments left on the Site must be made using your real name and legitimate email address that you own. You acknowledge that Amanda Bucklow may or may not pre-screen content, and that Amanda Bucklow and her designees shall have the right (but not the obligation) in our sole discretion to pre-screen, refuse, move or remove any User content from the Site, or to terminate any User’s right to access the Site with or without notice.

Amanda Bucklow may choose, at her own discretion and without notice, to remove content of any kind posted by Users that is not in the spirit of effective conflict resolution (including political diatribes).

Proprietary rights

The Site is the product of countless hours of professional experience combined with many hours of writing and recording. You acknowledge that content provided to you by the Site is protected by copyrights, trademarks, service marks, patents, or other proprietary rights and laws. Amanda Bucklow is sole owner of the Site and of all individual content in the Site unless explicitly stated otherwise, and you agree not to modify, rent, lease, sell, distribute, or create derivative works based on the Site, in whole or in part.

When so specified only, you are authorised to download one copy of the material from the Site on one computer for your personal, non-commercial use only and you may not in so doing remove or amend any trademark, copyright or other proprietary notice. If you wish to obtain use permissions beyond those described above, contact us.

No resale

Amanda Bucklow grants you a limited license to access and make personal use of this Site. You agree not to share, reproduce, duplicate, copy, sell, trade, resell, or exploit for any commercial purposes, any portion of the Site (including your membership ID), use of the Site, or access to the Site by any person other than yourself. Any unauthorised use terminates the permission or license granted by Amanda Bucklow.

Reliance on medical, legal, financial, investment and other information

The Site exists for the purpose of sharing insight, knowledge and experience via resources that are entertaining and educational. Please use your common sense and do not rely on any of the material found at the sites for your specific legal, financial, educational, medical or mental health needs. No information contained here should replace the advice and guidance of a qualified professional with whom you have an established relationship.

Revisions and errata

The materials appearing on the Site may include technical, typographical, or photographic errors. From time to time, we may make available to you certain services offered by third parties or pages of the sites may include links to other parties’ websites, which you may visit at your discretion. Those third party services and sites are not governed by Amanda Bucklow’s TOS or Privacy Policy, which do not cover collection, use, or disclosure by third parties through any applications, websites, products, or services that we do not control or own. Amanda Bucklow does not review all content on these external sites and is not responsible for the quality of information provided by them.

Use, access, and storage

You acknowledge that Amanda Bucklow may establish general practices and limits concerning use of the Site, including without limitation the maximum number of days that uploaded content will be retained by the Site, the maximum disk space that will be allotted on Amanda Bucklow’s servers on your behalf, and the maximum number of times (and the maximum duration for which) you may access the Site in a given period of time. You agree that Amanda Bucklow has no responsibility or liability for the deletion or failure to store any messages and other communications or other content maintained or transmitted by the Site. You also acknowledge that Amanda Bucklow reserves the right to log off and/or remove accounts that are inactive for an extended period of time. While our goal is to maintain the Site at all times, the Site may be taken down periodically for scheduled or emergency maintenance and updates. Events beyond our control may also prevent us from being able to deliver information and services on the Site, such as, but not limited to denial of service attacks, web hosting problems, availability of personnel, weather, or other force majeure-type acts beyond our control.

Disputes

You are solely responsible for your interactions with other Users on the Site. Amanda Bucklow reserves the right, but has no obligation, to monitor or take action regarding disputes between Users. In the event of disputes, Amanda Bucklow may in its sole discretion take such action as it deems appropriate, including but not limited to suspending or terminating your account or your ability to access the blog, and removing any User content.

Indemnification

You agree to indemnify and hold Amanda Bucklow and its subsidiaries, affiliates, officers, agents, employees, partners and licensors harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of content you submit, post, transmit or otherwise make available through the Site; your violation of the TOS, your violation of the rights of another, or your reliance upon information provided on the Site which results in the third party claim against you.

Termination

Amanda Bucklow may, under certain circumstances and without prior notice, immediately terminate your access to the Site. Cause for such termination shall include, but not be limited to: (a) breaches or violations of the TOS or other incorporated agreements or guidelines; (b) requests by law enforcement or other government agencies; (c) a request by you (self-initiated account deletions); (d) discontinuance or material modification to the blog (or any part thereof); (e) unexpected technical or security issues or problems; (f) extended periods of inactivity; (g) engagement by you in fraudulent or illegal activities; and/or (h) nonpayment of any fees owed by you in connection with the blog or any other Amanda Bucklow products or services. Termination of your access may include: (a) deletion of comments and all related information, files and materials, and (b) barring of further use of the Site. Further, you agree that all terminations for cause shall be made in Amanda Bucklow’s sole discretion and that Amanda Bucklow shall not be liable to you or any third party for any termination of any associated email address or access to the Site.

International communication

When you register for membership or post a comment on the Site, you acknowledge that you will be sending data transmissions through Amanda Bucklow computer networks located in the United Kingdom and, in some instances, portions of which may be located abroad. You further acknowledge that even communications that may seem to be national in nature can result in international transmission regardless of where you or we are physically located at the time of transmission.

Limitation of liability

You expressly understand and agree that Amanda Bucklow and its subsidiaries, affiliates, officers, employees, agents, partners and licensors shall not be liable to you for any direct, indirect, incidental, special, consequential or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Amanda Bucklow has been advised of the possibility of such damages), resulting from: (1) the use or the inability to use the Site; (2) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the Site; (3) unauthorised access to or alteration of your transmissions or data; (4) statements or conduct of any third party on the Site; or (5) any other matter relating to the Site.

Exclusions and limitations

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations of liability may not apply to you.

No waiver

Amanda Bucklow’s failure to exercise or enforce any right or provision of these TOS shall not operate as a waiver of such right or provision. This means that Amanda Bucklow may at any time choose to take an action that it is permitted or legally entitled to take, even if Amanda Bucklow has not taken such an action in the past, in the same or a similar situation.

Enforcement

Amanda Bucklow will take reasonable measures at our sole discretion to address activity not in accordance with this TOS or which we have good faith reason to believe may protect the safety of anyone or in instances where such disclosure is required by law. Such measures may include notification of and cooperation with law enforcement authorities.

Choice of law and forum

The TOS and the relationship between you and Amanda Bucklow shall be governed by the laws of England and Wales without regard to any principles of conflicts of law. You agree to submit to the exclusive personal jurisdiction of the courts sitting in and for England and Wales to resolve any disputes arising from this Site or these TOS.

Entire agreement

The TOS constitutes the entire agreement between you and Amanda Bucklow and governs your use of the Site, superseding any prior agreements between you and Amanda Bucklow with respect to the Site, with the exception of the Privacy Policy and the Cancellation and Refund Policy (for paid services), both of which are addressed separately. If you purchase any products or services, those purchased products will be subject to a Paid Services Terms of Services (“PSTOS”).

PAID SERVICES TERMS OF SERVICE

All Terms of Service (“TOS”) on the Site apply to paid or professional services, unless specifically modified by these Paid Services TOS. This website (“Site”) is owned and operated by Amanda Bucklow (“Amanda Bucklow,” “Company,” “we, or “us”). By purchasing any courses, programs, or products (“Product” or “Products”) from Amanda Bucklow you agree to be bound by these Paid Services Terms of Service (“PSTOS”), our Refund Policy, and any additional policies applicable to specific areas of the Site or Product.

Accessing the Site, in any manner, whether automated or otherwise, constitutes use of the Site and your agreement to be bound by these TOS. If you do not agree to these PSTOS, do not use the Site or purchase any Products or Services.

Certain services provided through the Site may create a privileged relationship, but those will be specifically identified when those services are obtained.

Amanda Bucklow and its subsidiaries, affiliates, officers, employees, agents, partners and licensors make no warranty that any paid products, services, information or other material purchased through the Site will meet your expectations

Availability of paid services

All references on this Site to a “Lifetime Access,” “Lifetime Membership,” or “Unlimited Use” refer to unlimited use of the referenced product or program for the duration of that product’s or program’s lifetime. Amanda Bucklow reserves the right to discontinue a program or product with or without notice at any time in our sole discretion. If a product or program is discontinued within three months of purchase by you, Amanda Bucklow will refund you 75% of the product purchase price. All refunds shall be processed and made within thirty (30) days of discontinuation. If a product or program is discontinued more than three months after purchase, Amanda Bucklow has no obligation to refund any amount.

In the event that lifetime or unlimited access becomes unavailable for whatever reason, a good faith effort will be attempted to contact the affected Users in order to send advance notification and provide time for the affected Users to obtain copies of downloadable material included in the lifetime access. Downloadable material is defined as product or program material that is specifically created by Amanda Bucklow to be downloaded by Users for that program.

All references on this Site to a “Lifetime Access,” “Lifetime Membership,” or “Unlimited Use” shall also mean the lifetime or course or duration of Amanda Bucklow. If at any time Amanda Bucklow ceases to exist, the lifetime access, membership, and unlimited use will no longer be in effect and all contracts are terminated.

Indemnification

You agree to indemnify and hold harmless Amanda Bucklow and its subsidiaries, affiliates, officers, agents, employees, partners and licensors from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of content you submit, post, transmit or otherwise make available through the Site; your violation of the TOS, your violation of the rights of another, or your reliance upon information provided on the Site which results in the third party claim against you.

Entire agreement

These PSTOS, combined with any unique terms of service for a particular product or service identified at enrolment constitutes the entire agreement between you and Amanda Bucklow and governs your use of the Site, superseding any prior agreements between you and Amanda Bucklow with respect to the Site, with the exception of the Privacy Policy and any product-specific Cancellation and Refund Policy, both of which are addressed separately.

PRIVACY POLICY

We take your privacy seriously. This policy describes the types of information we gather about you while you are using the amandabucklow.co.uk website and the ways in which we use this information. By visiting and using amandabucklow.co.uk (“the Site”), you agree that your use of the Site, and any dispute over privacy is governed by this policy.

When do I collect information about you?

I may collect information about you when you:

  • use my website
  • register with me for newsletters
  • enquire about, or place an order for, products or services
  • complete surveys
  • provide feedback or comments
  • participate in competitions
  • meet me at events or meetings
  • connect via social media

When you, register for email newsletters and distribution lists, or sign up for a discussion forum, you voluntarily provide the information needed to complete those transactions. Data Processors

I use Data Processors to carry out some tasks in accordance with our instructions. For example, we use an email software provider, an electronic newsletter automation platform, accountancy and banking software. This information is adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed. I regularly review these Data Processors to check they comply/conform with the latest data privacy regulations.

Third parties

We do not sell, trade, or rent your information to third parties, but occasionally use third parties to facilitate our business activities, including, but not limited to, website and product development, site hosting, maintenance, IT services, sending an email, processing payments, marketing, analytics, addressing technical problems, and enforcing our Terms of Service and other agreements. In connection with these offerings and business operations, these third parties may have access to your personal information for use in connection with our business activities.

We may also share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our Terms of Service, or as otherwise required by law. We may voluntarily provide any information you provide on the Site to any subpoenas for information, or as otherwise required by law.

If you purchase an online program, you may find advertising or other content that link to the websites and services of our partners, suppliers, advertisers, sponsors, licensors and other third parties. We do not control the content or links that appear on these websites and are not responsible for the practices employed by websites linked to or from our online programs. If you voluntarily make your personal information available on discussion boards, blog comments, or through email, that information may be seen, collected, and used by others besides us. We cannot be responsible for unauthorised third-party use of such information.

Opting out

You may close your user or subscriber account at any time, and request that we remove all of associated information and data we control, and we will delete it in its entirety. To do so, contact us.

You may opt-out of articles, newsletters, and resources you requested at any time by clicking “unsubscribe” at the foot of any subscriber email or by contacting us directly. If you decide to opt-out of receiving emailed resources from us, we will still send you emails notifying you of transactions that you may make on the site, important changes to services you may have purchased, and customer service issues that are required to provide you with services you may have purchased.

Archiving

I have an appropriate retention policy. I will archive certain customer or subscriber records held in my system after periods outlined below. These records are not deleted, but kept in a secure server storage where I will be able to retrieve them, if required.

Length of time records will be available live before being archived:

CANCELLATION AND REFUND POLICY

First and foremost, we want you to be fully satisfied with your purchase. If you have any questions, concerns, or problems, please contact us so we can try to set things right for you.

Public events

If you are unable to attend an in-person event sponsored by Amanda Bucklow, you may arrange to send a substitute in your place. Please contact us to arrange a substitution.

Your registration fee is refundable, less a £10 administrative fee, for cancellations received up to two weeks prior to the event’s date. No refunds are available if a cancellation is received within 14 days of the event date. Cancellation must be made in writing.

This policy applies only to those events organised and delivered by Amanda Bucklow. For events at which Amanda Bucklow is speaking, training, or teaching but which are offered by another organisation, that organisation’s refund policy will apply. Please contact the sponsoring organisation for assistance.

Online courses and products

Online Mediation Skills Training – Simulation (Retired)

A 7-day, 100% money-back guarantee with these terms:

  • Within the first seven days of start of membership, if you decide your purchase was not the right decision, request a refund by emailing refunds@amandabucklow.co.uk. Start of membership is defined as the date any membership material first became available to you and you have not accessed the simulation during that period. Upon cancellation within 7 days, access to membership materials will no longer be available to you via the Site.
  • After 7 days there are no refunds for any reason, though you may cancel your subscription at any time. You will not be charged again and your account will be closed the end of your current subscription period.

Five- and ten-session coaching packages are refundable with these terms:

  • Package cancellations requested prior to the first session will be refunded in full, less a £100 administrative fee. Package cancellations requested within 7 days after the first session will be refunded in full, less a £350 administrative and session fee. Cancellation and refund requests must be made in writing to refunds@amandabucklow.co.uk.
  • Package cancellations requested more than 7 days after the first session are non-refundable, though you may cancel your package at any time. Upon cancellation, access to any online coaching materials will no longer be available to you via the Site.
  • All unused sessions in a package expire 12 months after initial purchase.
  • Eligible refunds will be issued within 30 days of receipt of request in the same format by which original payment was made.

Single coaching session

Single coaching sessions are coaching sessions that are not part of a coaching package. Single coaching sessions are non-refundable, though they may be rescheduled prior to the appointment date. In the event you miss your scheduled stand-alone session, it is up to the discretion of Amanda Bucklow to permit rescheduling, and she is generally accommodating about rescheduling if her diary allows.
