The Family Law Courts are experiencing unprecedented pressure this year. The lack of public funding especially Legal Aid is a major factor that has also affected the uptake of mediation.

The number of publicly funded mediation and information assessment meetings (MIAMs) has fallen by 66% while the number of mediations has fallen by 54%.

In March 2019, Cafcass received 4,166 new private law cases – 18% more than in March 2018 and the highest March on record.

Emergency measures, proposed by Sir Andrew McFarlane, president of the family division, might include judges ensuring parents attend mediation before proceedings commence.
